Please read these Terms and Conditions (“Terms” or “Terms and Conditions”) carefully before using the www.pet.digitail.io website, www.vet.digitail.io/clinics and the mobile app – Digitail for Pets (together, or individually, the “Service”) operated by Digitail Innovation SRL (“Digitail”, “us”, “we”, or “our”). For purposes of these Terms, “you” and “your” means you as the user of the Service.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Service
Our Service consists of:
A. Digitail for Pets – the mobile app for pet owners;
B. Digitail Vet Booking – the pet care provider’s public Appointments Booking page that can be found at www.vet.digitail.io/clinics/[CLINIC NAME]
Digitail for Pets allows you to communicate with you pet care providers (vets), book appointments, view the medical history of your pets, log information about your pets, etc.
Digitail Vet Booking is a public page of your pet care provider. You can access this page in order to request an appointment or create a new account.
You are fully responsable for your actions using the Service and you are not allowed to use fake or incorrect information or missuse the Service in any way.
2. Access
The access to Digitail App is done through an email address and a unique, individual and private password, known solely by the user. There are two ways to create an account:
A. Directly on Digitail App
B. Created by a care providers that uses Digitail for Vets (Veterinary Software for Practice Management)
3. Accounts
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your phone and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use the name or email of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a name or email any name that is offensive, vulgar or obscene.
You may not use the Service if you are 14 years of age or younger. By using the Service, you represent and warrant that you are over the age of 14.
4. Communications
Communications from Digitail
By creating an account on our Service, you agree to subscribe to newsletters or marketing materials and other promotional information we may send. However, you may opt out of receiving any, or all, of these marketing communications from us by following the unsubscribe link or instructions provided in any email we send. Please note that we may still send you transactional or administrative messages related to the Service even after you have opted out of receiving marketing communications.
Communications from your provider
By allowing your pet care provider to add you in their CRM system (Digitail for Vets) and to create an account on our Service, you agree to receive emails and / or SMS messages from your provider.
5. Copyright, brand and intellectual property
The Service and its original content, the texts, graphic, photographs, software, logos, features and functionality are and will remain the exclusive property of Digitail and its licensors / partners.
6. Restrictions on your use of the service
You may not do any of the following, unless applicable laws or regulations prohibit these restrictions, or you have our written permission to do so:
– duplicate, decompile, reverse engineer, disassemble or decode the Service (including any underlying idea or algorithm), or attempt to do any of the same;
– access or use the Service in any manner that could disable, overburden, damage, disrupt or impair the Service or interfere with any other party’s access to or use of the Service or use any device, software or routine that causes the same;
– attempt to gain unauthorized access to, interfere with, damage or disrupt the Service, accounts registered to other users, or the computer systems or networks connected to the Service;
– circumvent, remove, alter, deactivate, degrade or thwart any technological measure or content protections of the Service;
– use any robot, spider, crawlers or other automatic device, process, software or queries that intercepts, “mines,” scrapes or otherwise accesses the Service to monitor, extract, copy or collect information or data from or through the Service, or engage in any manual process to do the same;
– introduce any viruses, trojan horses, worms, logic bombs or other materials that are malicious or technologically harmful;
– use the Service for illegal, harassing, unethical, or disruptive purposes;
– violate any applicable law or regulation in connection with your access to or use of the Service; or
– access or use the Service in any way not expressly permitted by these Terms.
7. Feedback and ideas
We welcome feedback, comments and suggestions for improvements to the Service (“Feedback”). You acknowledge and expressly agree that any contribution of Feedback does not and will not give or grant you any right, title or interest in the Service or in any such Feedback. All Feedback becomes the sole and exclusive property of Digitail, and Digitail may use and disclose Feedback in any manner and for any purpose whatsoever without further notice or compensation to you and without retention by you of any proprietary or other right or claim. You hereby assign to Digitail any and all right, title and interest (including, but not limited to, any patent, copyright, trade secret, trademark, show-how, know-how, moral rights and any and all other intellectual property right) that you may have in and to any and all Feedback.
7. Third parties
Our Service may contain links to third party web sites or services that are not owned or controlled by Digitail. Our Service may also allow you to import or interface with third party applications or services.
Digitail has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that Digitail shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit or interact with.
8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you can send us an email at support@digitail.io requesting us to delete your account.
9. Exoneration & limitation of liability
By accepting to use this app you implicitly declare you understand the purpose of this electronic platform and you take full responsibility for using it only in the purpose described here.
Digitail will not be responsible for any direct, indirect, accidental, special damage, including but not limited to profit loss, goodwill, usage possibilities, data or any other intangible or incommensurable damage.
For the content that may contain readers’ opinions, the responsibility for the content is entirely the authors’. Digitail reserves the right not to publish those opinions that are against the terms and conditions of using the website or considers harmful in any way to its own image, to the partners’ image or to third parties.
Digitail does not offer any guarantee that the services will be uninterrupted, on time, certain or without errors.
Digitail is not responsible for the quality of any services you obtain through the Service, that doesn’t satisfy all your demands.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
